First Circuit Allows Constitutional Claims Against N.H. Health Commissioner over Involuntary Admissions for Mental Health Care

The First Circuit allowed October 26 a class of patients and a group of hospitals to move forward with their respective due process and unlawful takings claims against the New Hampshire Department of Health and Human Services Commissioner for failing to ensure timely probable cause hearings for those deemed to need emergency mental health treatment.
