Eighth Circuit Holds ERISA Preempts State Law Regulating PBMs

Reversing a lower court decision, the Eighth Circuit held August 7 that the Employee Retirement Income Security Act (ERISA) preempted North Dakota legislation regulating the relationship between pharmacy benefit managers (PBMs) and pharmacies.
