U.S. Court in New Jersey Finds Cross-Plan Offsetting Violates ERISA

Aetna Health and Aetna Life Insurance Company (collectively, Aetna) violated the Employee Retirement Income Security Act (ERISA) when it offset overpayments made to medical providers under one plan from payments due to them under another plan, a federal court in New Jersey held June 21.
