U.S. Court in California Allows Government’s FCA Claims Against Kaiser Permanente Alleging Medicare Advantage Fraud

The U.S. District Court for the Northern District of California refused November 14 to dismiss the bulk of the federal government’s claims under the False Claims Act (FCA) alleging the Kaiser Permanente consortium engaged in a scheme to unlawfully obtain additional Medicare Advantage payments by adding diagnoses codes to patient medical records months, or even years, after in-person patient encounters.
