Ninth Circuit Says FCA Doesn’t Require “Objective Falsity”

The Ninth Circuit held March 23 that the False Claims Act (FCA) imposes no requirement that a plaintiff prove “objective falsity.” Therefore, the appeals court said, a physician’s false certification of medical necessity can give rise to FCA liability.
