Ninth Circuit Won’t Rehear Decision Holding LCDs Not Subject to Notice and Comment

The Ninth Circuit denied September 2 a petition for rehearing en banc of a divided panel decision holding that the Medicare Act’s notice-and-comment requirements do not apply to Local Coverage Determinations (LCDs) made by Medicare contractors.
