Second Circuit Revives Nursing Home Challenge to Survey Team Regulation

A group of nursing homes that participate in both Medicare and Medicaid should be allowed to proceed with their challenge to a regulation governing the make-up of survey teams, the Second Circuit held April 27 in reversing dismissal of the action for lack of subject matter jurisdiction.
