U.S. Court in Maryland Again Rejects Whistleblower Action Alleging Kickback Scheme

A federal court in Maryland refused May 18 to reconsider its dismissal of a relator’s third amended complaint alleging two medical device manufacturers—Allergan, Inc. and Apollo Endosurgery, Inc.—violated the False Claims Act by providing surgeons valuable free advertising to induce them to recommend defendants’ LAP-BAND product for treating obesity.
