Supreme Court to Consider Availability of Emotional Distress Damages Under Federal Anti-Discrimination Laws

The Supreme Court agreed July 2 to review a Fifth Circuit decision holding emotional distress damages are not recoverable under Section 504 of the Rehabilitation Act (RA) or Section 1557 of the Affordable Care Act (ACA).
