U.S. Court in Massachusetts Says AKS Violation Is a Per Se Violation of FCA

A federal district court in Massachusetts ruled July 5 that a violation of the Anti-Kickback Statute (AKS) is a per se violation of the False Claims Act (FCA) in a whistleblower action alleging defendant Biogen Inc. caused health care providers to submit false claims to Medicare and Medicaid that were tainted by kickbacks.
