U.S. Court in Tennessee Allows FCA Action Against Walgreen Alleging Failure to Return Overpayments

The federal government sufficiently pleaded that Walgreen Co. violated the False Claims Act (FCA) by knowingly and improperly failing to return overpayments after one of its pharmacy employees submitted fraudulent claims for pricey Hepatitis C drugs to TennCare, Tennessee’s Medicaid program, the U.S. District Court for the Eastern District of Tennessee held March 14.
