Sixth Circuit Affirms Dismissal of EMTALA, ACA Anti-Discrimination Claims

The Sixth Circuit affirmed July 20 the dismissal of claims under Section 1557 of the Affordable Care Act (ACA) and the Emergency Medical Treatment and Labor Act (EMTALA). According to the appeals court, the plaintiff failed to meet the exhaustion requirements for the ACA claim and to rebut the defendant hospital’s experts who found the decedent was stable prior to her transfer for purposes of the alleged EMTALA violations.
