Fourth Circuit Allows Plan Participant to Pursue Administrative Appeal After United Failed to Respond to Document, Records Request

United Healthcare Insurance Company failed to comply with Employee Retirement Income Security Act (ERISA) procedural requirements when it did not respond to a request for plan documents in a participant’s dispute over the denial of coverage for his son’s residential behavioral health treatment, the Fourth Circuit said recently.
