U.S. Court in D.C. Sides with HHS in Challenge to Medicare DSH Formula

The U.S. District Court for the District of Columbia granted June 7 summary judgment to the Department of Health and Human Services (HHS) Secretary in an action brought by more than 200 acute care hospitals challenging the agency’s formula for counting low-income patients for purposes of the disproportionate share hospital (DSH) adjustment.
