Tennessee Appeals Court Says Lower Court Erred in Looking Back to Circumstances of Health Care Power of Attorney Execution

A trial court erred in looking beyond a power of attorney for health care to consider the circumstances surrounding its execution and whether the principal was competent to sign the power of attorney in the first place, the Court of Appeals of Tennessee said February 28.
