On February 3, 2023, the U.S. Department of Justice (DOJ) withdrew its support for three longstanding policy statements on health care antitrust enforcement. These statements, which were issued jointly with the Federal Trade Commission (FTC), have served as safe harbor guidelines to health care providers and other entities for nearly three decades. The DOJ’s withdrawal presents important issues for health care providers.
