Medical Staff Bylaws as Enforceable Contracts: Limiting Hospital Governance or Business as Usual?

A s more courts recognize medical staff bylaws as enforceable contracts, questions have arisen as to the rights of the parties under the bylaws. The drafting of medical staff bylaws and the language used can be an important tool for hospitals to maintain control over the medical staff. Similarly, physicians and other health care professionals must carefully review and consider the corporate and medical staff bylaws of any hospital that he or she seeks to join.
