Trump’s DOJ Stays the Course in Opposition to Shared Algorithmic Pricing

In an antitrust class action by health care providers against MultiPlan, Inc. (MultiPlan) and the insurers who employ its automatic claim-negotiation tool, the Department of Justice (DOJ) signaled its continued hostility towards shared algorithmic pricing in a Statement of Interest opposing MultiPlan’s motions to dismiss. DOJ’s filing asserts that, as a matter of law, agreements among competitors to adhere to identical steps, processes, or behaviors in determining prices are just as illegal as agreements to set the end prices.
