California Court of Appeal Recently Determined That Kern Medical Center Did Not Violate Its Bylaws in Terminating a Physician’s Privileges Without a Hearing

Farzin Tayefeh, M.D. (Dr. Tayefeh), an anesthesiologist, filed suit against Kern Medical Center (KMC) and the County of Kern, alleging several claims, including violation of his right to a hearing after KMC terminated his temporary medical staff privileges. Following a bench trial, the lower court determined that KMC did not violate its bylaws because its action was not based on a medical disciplinary cause or reason. The California Court of Appeal affirmed the trial court’s decision and found that Dr. Tayefeh was not entitled to a hearing and appellate rights under KMC’s bylaws.
