Earlier this year, the Indiana Court of Appeals upheld a trial court ruling that allowed a hospital to claim immunity and avoid suit under the Health Care and Quality Improvement Act (HCQIA). This ruling should serve as a reminder for professional review bodies, and their counsel, to be mindful of the HCQIA standards when exercising professional review actions, so the body may be afforded protection in the event litigation ensues.
