OIG Issues an Advisory Opinion Approving Patient Incentives Used for Contingency Management to Treat Substance Use Disorders

On March 2, 2022, the Office of Inspector General for the Department of Health and Human Services (OIG) issued Advisory Opinion No. 22-04 approving the use of patient incentives used for contingency management to treat substance use disorders. OIG concluded that, although the contingency management program and its use of patient incentives would typically present substantial risk under fraud and abuse statutes, it would not impose administration sanctions given that the risk of harm is low.
