Digital health and innovation are reshaping health care at an unprecedented pace, and there’s no slowing down. By some account, the global digital health market, valued at $260.9 billion in 2023, is projected to reach more than $1.9 trillion by 2033. In more ways than one, digital health is the future of health care delivery and services, both in the United States and globally. With this rapid growth, however, comes the uncertainty of risks associated with a legislative and enforcement landscape that evolves more slowly, a challenge health care lawyers face every day. This article discusses the rise of digital health (and, in turn, the development of artificial intelligence (AI) in health care systems) and how legal practitioners can guide clients through the risks associated with these innovations.
