Eleventh Circuit Backs Employees in COVID Hazard-Pay Overtime Row, But Rejects Other FLSA, FMLA Claims

A lower court properly ruled in favor of several employees who contended an Alabama retirement and assisted living facility was required under the Fair Labor Standards Act (FLSA) to include COVID-19 pandemic-related hazard pay and other financial incentives in their regular rate of pay for purposes of calculating overtime, an Eleventh Circuit panel held May 8 in an unpublished opinion.
