U.S. Court in NY Says Plan Didn’t Violate ERISA, Parity Act in Denying Coverage for Mental Health Treatment

The U.S. District Court for the Western District of New York upheld March 19 a health plan’s denial of residential mental health treatment for a minor. In so holding, the court rejected plaintiffs’ claims under both the Employee Retirement Income Security Act (ERISA) and the Mental Health Parity and Addiction Equity Act of 2008 (Parity Act).
