Supreme Court Vacates, Remands Decision Striking Health Plans’ Categorical Exclusions of Gender-Affirming Care as Unconstitutional

The Supreme Court vacated June 30 the Fourth Circuit’s decision that categorical exclusions of gender-affirming care in North Carolina’s health plan for state employees and in West Virginia’s Medicaid program violated equal protection by discriminating on the basis of gender identity and sex.
