Second Circuit Rejects Surgeons’ Constitutional Challenge to No Surprises Act

A surgeon and his practice associates failed to revive their action challenging the constitutionality of the No Surprises Act (Act), with the Second Circuit affirming the dismissal of the lawsuit in a summary order issued January 23. However, the Second Circuit remanded to the district court to potentially allow plaintiffs to replead one of their claims.
