A participant in an employee benefits plan could not revive a class action against CaremarkPCS Health, LLC alleging it violated an Arkansas statute by requiring members to fill maintenance prescriptions at CVS retail pharmacy stores or through its mail-order delivery service because federal law preempted the state provision, the Eighth Circuit held.
