Supreme Court Won’t Review Decision on FCA Falsity Based on Divergent Medical Opinions

The U.S. Supreme Court declined February 22 to review a Third Circuit decision reversing the dismissal of a False Claims Act (FCA) whistleblower action against a hospice provider after finding a difference in medical opinions could raise a triable issue on FCA falsity.
