U.S. Court in Michigan Dismisses ECPA Claim Against ADHD Online Platform over Website Disclosures

The U.S. District Court for the Western District of Michigan dismissed a proposed class action brought by former users of ADHD Online, operated by Mentavi Inc., who alleged that the company unlawfully intercepted their communications in violation of the federal Electronic Communications Privacy Act (ECPA). The court held that Mentavi, as a party to the electronic communications, was exempt from liability under the ECPA’s one-party consent rule because plaintiffs failed to plausibly allege that the company acted “for the purpose” of committing a crime or tort.
