Fourth Circuit Affirms Dismissal of FCA, Retaliation Claims

A lower court’s dismissal with prejudice of a qui tam relator’s false claims action was proper, the Fourth Circuit said in an unpublished June 15 opinion. In so holding, the appeals court agreed with the lower court’s conclusions that the relator failed to allege sufficient scienter and didn’t properly support his retaliation claim.
