A federal court in California dismissed, with leave to amend, a lawsuit brought by the Pharmaceutical Care Management Association (PCMA) contending the Employee Retirement Income Security Act (ERISA) preempted a California statute (SB 41) imposing fiduciary duties on pharmacy benefit managers (PBMs) to self-insured employer plans.
