OIG Says Financial Arrangement Between MSOs, Providers Falls Under Safe Harbor

An arrangement in which a management support organization (Requestor Inc.) and an affiliated professional corporation (Requestor PC) would enter into an agreement with telehealth providers to lease employees and provide certain administrative services would implicate the Anti-Kickback Statute, but meets all of the conditions of the safe harbor for personal services and management contracts and outcomes-based payment arrangements, the Department of Health and Human Services Office of Inspector General (OIG) said in an advisory opinion issued June 11.
