U.S. Court in Nevada Says Claims Based on Social Distancing Failures Not Covered Under PREP Act

Negligence claims based on a nursing home’s alleged failure to isolate and maintain social distancing of residents amid the COVID-19 pandemic are not entitled to federal question jurisdiction under the federal Public Readiness and Emergency Preparedness (PREP) Act, because those actions aren’t “covered countermeasures,” the U.S. District Court for the District of Nevada held February 18.
