U.S. Court in Illinois Nixes FCA Action Alleging Safeway Inflated “Usual and Customary” Charges

The U.S. District Court for the Central District of Illinois granted June 12 Safeway, Inc. summary judgment in a whistleblower action under the False Claims Act (FCA) for failing to treat discount prices through member-only discount and price-matching programs offered at the grocery store chain’s pharmacies as the “usual and customary” price for government programs.
