OIG OKs Company’s Contributions to Charitable Foundation

An arrangement under which a company makes financial contributions to a related foundation that provides grants to families of children receiving a particular type of therapy would generate prohibited remuneration under the Anti-Kickback Statute (AKS) if the requisite intent were present, but the Department of Health and Human Services Office of Inspector General (OIG) would not impose administrative sanctions, the agency said in an advisory opinion posted September 11.
