Drug Rebate Final Rule Delayed Until 2023, HHS Says

The Department of Health and Human Services (HHS) Office of Inspector General (OIG) is delaying until 2023 a controversial final rule that removes safe harbor protection under the Anti-Kickback Statute (AKS) for rebates that drug manufacturers pay to pharmacy benefit managers (PBMs) and health plans following a recently issued court order.
