U.S. Court in Texas Says Medicare Recoupment Before ALJ Hearing Not a Due Process Violation

The U.S. District Court for the Southern District of Texas granted the Department of Health and Human Services (HHS) summary judgment January 6 on claims that its recoupment of Medicare overpayment funds before providing a hearing before an Administrative Law Judge (ALJ) violated the provider’s due process rights.
