A divided West Virginia Supreme Court of Appeals declined May 12 to resolve whether the state’s common law allows a public nuisance claim against the nation’s three largest drug distributors—McKesson Corporation, Cardinal Health Inc., and AmerisourceBergen Drug Corporation—for their alleged roles in fueling the opioid crisis in a hard-hit West Virginia community.
