Michigan Appeals Court Says Lower Court Erred in Allowing Discovery of Emails Protected by Peer Review Privilege

The Court of Appeals of Michigan said April 2 a trial court erred in concluding that certain emails to a member of a peer review committee were not protected by the peer review privilege. The lower court’s interpretation of the statutory privilege conflicted with its plain language and didn’t take the context of the emails into consideration, the appeals court found.
