Ninth Circuit Revives ERISA Action Against Plan Administrator over Hernia Repair Coverage Denials

A district court improperly concluded that UnitedHealthcare Insurance Company’s (United’s) failure to adequately explain its coverage denials of two plan participants’ hernia repairs during weight loss surgeries amounted to harmless error, the Ninth Circuit held in a July 15 unpublished opinion.
