Supreme Court Won’t Consider Constitutionality of FCA Whistleblower Provisions in Eli Lilly Medicaid Fraud Action

The U.S. Supreme Court declined May 18 to hear Eli Lilly & Co’s constitutional challenge to the False Claims Act’s qui tam provisions, leaving intact a $183 million judgment stemming from a whistleblower suit alleging the drugmaker defrauded Medicaid by underpaying rebates.
