Tenth Circuit Revives ERISA Action Involving Plan’s Residential Treatment Denial

A district court improperly applied a deferential standard of review to a plan administrator’s decision to deny a claim for coverage of mental health treatment at a residential treatment facility, the Tenth Circuit held July 24 in remanding the action under the Employee Retirement Income Security Act (ERISA) for de novo review.
