New DOJ Corporate Crime Guidelines Present Major Governance and Compliance Challenges

On September 15, Deputy Attorney General Linda O. Monaco announced a series of substantive changes the Department of Justice (DOJ) is implementing in order to further strengthen how DOJ prioritizes and prosecutes corporate crime (Monaco Guidelines). These changes, which reflect enhancements to long-standing DOJ guidelines on individual accountability, follow an almost year-long, “top to bottom” review of its corporate enforcement efforts.
