Fourth Circuit Revives Whistleblower Action Alleging Underpayments of Medicaid Rebates

A split Fourth Circuit panel reversed March 13 the dismissal of a qui tam action alleging that a subsidiary of Allergan Sales, LLC violated the False Claims Act (FCA) by providing false price reports to the government under the Medicaid Drug Rebate Program, causing the company to underpay rebates to the program by more than $686 million over ten years.
