In September 2023, Humana (plaintiff) brought suit against the Centers for Medicare & Medicaid Services (CMS) in the U.S. District Court for the Northern District of Texas alleging that CMS did not follow procedural requirements under the Administrative Procedure Act (APA) when promulgating its 2023 Medicare Advantage Risk Adjustment Data Validation Final Rule.
