Arkansas Appeals Court Rejects Arbitration of Wrongful Death Action Against Nursing Home

A wrongful death action against a Faulkner-Progressive Eldercare Services, Inc. nursing home is not subject to arbitration because the agreement signed by the deceased resident’s son was not a valid contract between the parties, an appeals court in the state ruled March 15.
