Fourth Circuit Partially Revives ERISA Action Involving Heart Transplant Coverage Denial

The Fourth Circuit held September 11 that the mother of a 27-year-old flight attendant who died while awaiting a heart transplant may have an actionable claim under the Employee Retirement Income Security Act (ERISA) for unjust enrichment against her son’s health plan and its administrators.
