Texas Supreme Court Spells out Limits on Vicarious Liability of Nonprofit Health Care Organizations That Employ Physicians

A Texas Nonprofit Health Organization (NPHO) can avoid vicarious liability for the alleged negligence of a physician employee if it shows either that it lacked any relevant right of control or that any control it may have had interfered with the physician’s medical judgment contrary to state law, the Texas Supreme Court held May 27.
