U.S. Court in New York Trims Safety-Net Providers’ State Antitrust Claims Against Drug Makers over 340B Discounts

The U.S. District Court for the District of New York dismissed two state-law antitrust and all unjust enrichment claims in a putative class action brought by safety-net providers against four major pharmaceutical companies over their alleged coordinated effort to rescind long-standing discounts for certain types of insulin under the 340B program. However, the court allowed the remaining state law antitrust claims to proceed because they did not require construing the 340B statute or essentially constitute a back-door effort to enforce its provisions.
