U.S. Court in Mississippi Nixes HHS Final Rule on ACA Nondiscrimination Protections Based on Gender Identity

The Department of Health and Human Services (HHS) exceeded its statutory authority in promulgating a final rule spelling out that the Affordable Care Act’s (ACA’s) nondiscrimination prohibition in health care “on the basis of sex” includes gender identity, a federal court in Mississippi held October 22.
